Bankruptcies and the Runoff Market – Impacts and Implications

  • A discussion about the growing number of mass-tort bankruptcies and the role of insurance and reinsurance companies, in particular what rights they have to weigh in on the bankruptcy plans.  The discussion will including a look at current cases including those before the Supreme Court that may have a significant impact on insurance and reinsurance companies, as well as the runoff market in the future.

Should Covid-19 be Considered a Natural Peril?? 

  • While the Covid-19 pandemic may feel like a distant memory to some, disputes about recovery of Covid-19 losses are very much front and center in the reinsurance industry.  While majority of the U.S. courts have determined that there is no business interruption coverage under primary property policies for Covid-19 losses because the same do not present a physical loss of or damage to property, the non-U.S. courts have reached a different conclusion due to the different wordings of the primary policies in numerous foreign jurisdictions.  The panelists present competing arguments whether Covid-19 was/was not a natural peril and will point to provisions that may be considered in answering this question.

  • As we face ever-present, shifting challenges — a changing global economy, complex market conditions, evolving regulatory requirements, growing stakeholder demands and any number of unknown risks — what critical pieces will prove to be the missing links?

What’s Trending in the World of Arbitration?

  • The panel will offer insights on recent decisions on arbitration-related issues in the US and abroad – including cases involving alleged evident partiality, failure to hear evidence, and corruption.  The content will include a review of AIRROC’s recently updated streamlined Dispute Resolution Process (DRP) as well as an overview of other recent arbitral reforms.

BIPA: Developments in the Legislature and the Courts

  • This session will discuss the Illinois Biometric Information Privacy Act, a frequent source of insurance coverage disputes in Illinois and nationwide.  We will focus on the implications of the statute for policyholders, ongoing legislative developments, and key issues of dispute in insurance coverage matters.  

Prospective Structured Solutions (and YES - they are applicable to legacy!)

  • Creative structured solutions are used widely in the Re/Insurance space for Prospective Business and can also apply to legacy. Yesterday’s underwriting is tomorrow’s legacy!   The panelists will discuss types of transactions and case studies from the live market that can also be applicable in the Legacy Space.

Rates for non-members: $299 per person to attend in person and $199 for Livestream access to the education sessions.

Continuing Legal Education:
